RE: The tariff classification of aluminum tubes from China.
Dear Ms. Ford:
In your letter dated November 2, 2006, on behalf of your client TVI Corporation, you requested a tariff classification ruling. A representative sample was submitted with your request.
The product to be imported is a hollow tube comprised of one hundred percent aluminum. Black in color due to anodizing, this tube is seamless and measures 0.625 inches in diameter and 29 inches in length. After importation, these tubes will be drilled and ultimately used in the framework of a tent canopy.
The applicable subheading for the aluminum tubes will be 7608.10.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for aluminum tubes and pipes, of aluminum, not alloyed, seamless. The rate of duty will be 5.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
