RE: The tariff classification of NatureGuard™ Rosemary Extract P20 from Canada
Dear Mr. Johnson:
In your letter dated December 11, 2006 you requested a tariff classification ruling. A sample was submitted with your ruling request and will not be returned.
Your inquiry concerns the classification of a product you describe as NatureGuard™ Rosemary Extract P20. The product consists of extracted rosemary oleoresin produced by supercritical carbon dioxide extraction and standardized with maltodextrin. Silicon dioxide is added as a processing aid. The extracted rosemary oleoresin is produced in Canada, whereas the maltodextrin and silicon dioxide are of U.S. origin. NatureGuard™ Rosemary Extract P20 is an oil dispersible powder. The product is sold as a raw material, which will be primarily used as a flavoring component.
The applicable subheading for NatureGuard™ Rosemary Extract P20 will be 3302.10.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Mixtures of odoriferous substances and mixtures (including alcoholic solutions) with a basis of one or more of these substances, of a kind used as raw materials in industry: Other preparations based on odoriferous substances, of a kind used for the manufacture of beverages: Of a kind used in the food or drink industries: Not containing alcohol. The rate of duty will be free.
