RE: The tariff classification of a woman’s Shrug from China.

Dear Ms. Shira:

In your letter dated January 8, 2007, on behalf of your client Polo Ralph Lauren, you requested a classification ruling for a woman’s shrug.

The submitted sample, Style #SO720X11F is a woman’s shrug constructed from 100% linen knit fabric. The garment has sleeves, shoulder coverage, a full front opening with no means of closure, and a back that extends approximately 44 inches. The garment has essentially no front coverage.

We are returning your sample as you requested.

The applicable subheading for Style SO720X11F will be 6114.90.9070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted of other textile materials, other, other, other. The rate of duty will be 5.6% ad valorem.

The Shrug, Style SO720X11F, falls within textile category 859. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
