RE: The tariff classification of messenger-style bag from China

Dear Ms. Stares:

In your letter dated January 18, 2007, you requested a classification ruling. Your sample is being returned to you.

The sample submitted is identified as a “men’s carry bag,” style number TGMB16631. It is designed to transport items normally carried to and from the office or school. It is manufactured with an exterior surface of 100% cotton textile material. It features one textile-lined divided storage compartment with slots for pens, pencils, cell phone, etc. The bag also has a flap opening secured with a hook and loop closure, an adjustable shoulder strap, and one zippered pocket on both the interior and exterior of the bag. It measures approximately 15.5” (W) X 11” (H) X 3” (D).

The applicable subheading for the carry bag will be 4202.12.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for briefcases, school satchels, etc., with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.3 percent ad valorem.

HTS 4202.12.4000 falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
