RE: The tariff classification of cleaning cloths, textile padded clothes hangers and clothespins from China and Korea
Dear Ms. Simpson:
In your letter dated March 24, 2007 you requested a classification ruling on behalf of The Evercare Company.
The submitted samples are a “4-pk Microfiber Cleaning Cloths”, “Evercare Microfiber Cleaning Cloth”, “Lavender Scented Padded Clothes Hangers” and “Woolite Gentle Care Clothespins”. The “4-pk Microfiber Cleaning Cloths” are made from 70 percent polyester and 30 percent nylon. The fabric construction of two of the cloths is a knit pile, the other a flat knit and the last a woven napped (sueded). All of the cloths measure 14 x 16 inches and the edges are finished with an overlock stitch. The three “Lavender Scented Padded Clothes Hangers” are contained in a heat sealed clear plastic bag. The hangers are made from a wooden frame padded with polyester fiber filling and covered 100 percent polyester woven fabric. Attached at the center of the article is a wire hook. They measure approximately 15 inches in length and feature a textile ribbon bow as a decorative accent. The “Woolite Gentle Care Clothespins” are spring type clothespins made from plastic.
The applicable subheading for the 4-pk Microfiber Cleaning Cloths” will be 6307.10.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: other… other. The duty rate will be 5.3 percent ad valorem.
The applicable subheading for the “Lavender Scented Padded Clothes Hangers” will be 6307.90.9889, HTSUS, which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem.
The applicable subheading for the “Woolite Gentle Care Clothespins” will be 3926.90.6550, HTSUS, which provides for other articles of plastics and articles of other materials of heading 3901 to 3914: other: clothespins: spring type… valued over $1.70 per gross.

Subheading 6307.10.2030 is not assigned a textile category designation. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. Your inquiry does not provide enough information for us to give a classification ruling on “Evercare Microfiber Cleaning Cloth”. Your request for a classification ruling should include the following information:
Is the fabric a warp or weft knit?
What type of fabric construction is the cloth woven or knit?
Provide the generic name of the fiber (i.e. polyester, etc.).
When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
