RE: The tariff classification of women’s suit-type jackets from various countries
Dear Ms. Chioccola:
In your letter dated May 8, 2007, you requested a classification ruling. Your samples will be returned as requested.
Submitted sample, style #6164, is a woman’s suit-type jacket constructed from 100% acrylic woven fabric. The fully lined jacket extends from the shoulders to the waist and features a collar, long sleeves and an off center full front opening secured by one button and a snap closure.
Submitted sample, style #6196, is a woman’s suit-type jacket constructed from 62% polyester, 34% rayon and 4% spandex woven fabric. The fully lined jacket features a round neckline, long sleeves with ruffled cuffs, a full front opening secured by three buttons, shoulder pads and a ruffled bottom.
The applicable subheading for styles 6164 and 6196 will be 6204.33.5010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-types jackets and blazers: of synthetic fibers: other: women’s. The duty rate will be 27.3 percent ad valorem.

Styles 6164 and 6196 fall within textile category 635. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
