RE: The tariff classification of a woman’s blouse from China
Dear Mr. Hoffacker:
In your letter dated May 21, 2007, you requested a classification ruling on behalf of Sugartown Worldwide Inc. Your sample will be returned as requested.
Submitted sample, style #66229, is a woman’s blouse constructed from 100% silk woven fabric. The pullover is sleeveless blouse and measures approximately 11/2 inches wide at the shoulder seam. The fully lined garment features a v-neckline, a partial opened scooped back secured by five buttons, an empire waist, a tie in the back and a hemmed bottom.
The applicable subheading for the style 66229 will be 6211.49.1050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of other textile materials: containing 70 percent or more by weight of silk or silk waste: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206. The duty rate will be 1.2 percent ad valorem.

Style 66229 falls within textile category 741. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
