RE: The tariff classification of a woman’s dress from China
Dear Ms. Baron:
In your letter dated June 3, 2007, you requested a classification ruling on behalf of Michael Kors. Your sample will be returned as requested.
Submitted sample, style #888/BD, is a woman’s dress constructed from 100% linen woven fabric. The pullover garment features ¾ length sleeves, a round neckline, a partial front opening secured by three snap closures, a back zipper and a hemmed bottom. The neckline and partial front opening are embellished with beads.
The applicable subheading for the style 888/BD will be 6204.49.5060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of other textile materials: other: other: other. The duty rate will be 6.9 percent ad valorem.

Style 888/BD falls within textile category 836. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
