RE: The tariff classification of an adult costume from China.

Dear Mr. August: In your letter dated September 24, 2007, you requested a tariff classification ruling. The sample which you submitted is being returned as requested.

The submitted sample, Sexy Sorceress Costume, Styles 5108 and 5108H consists of a dress made of knit polyester velour fabric. The dress is designed with an attached hood, two long slits at the front, long sleeves that widen at the bottom, a scooped neckline with lace trim, and embellishments at the bodice, sleeves and at the bottom of the dress.

The Sexy Sorceress Costume is well made with a finished neck, styling and embellishments.        The applicable subheading for the Sexy Sorceress Costume, Styles 5108 and 5108H, will be 6104.43.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear); knitted or crocheted: Dresses: Of synthetic fibers, Other, Women’s." The rate of duty will be 16% ad valorem. The textile category designation is 636.
