RE: The tariff classification of two women’s sleeveless pullovers from India.
Dear Ms. Barlow:
In your letter dated October 19, 2007 you requested a classification ruling. As requested, your samples are being returned to you.
Style number 122 is a woman’s cut and sewn sleeveless pullover that is constructed from 70% modal and 30% cotton knitted fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a v-shaped neckline and a hemmed bottom.
Style number 123 is a woman’s cut and sewn sleeveless pullover that is also constructed from 70% modal and 30% cotton knitted fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a scoop front neckline, three button closures on the wearer’s left side at the garment bottom, and a hemmed bottom.
The applicable subheading for both styles will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: Other: other: other: other: women’s or girls’. The duty rate will be 32%.

Both styles fall within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
