RE: The tariff classification of a genie costume from Taiwan.
Dear Ms. Lee:
In your letter dated November 19, 2007, on behalf of Sears Holdings Global Sourcing Ltd., you requested a classification ruling. As requested, the sample will be returned.

The submitted sample is a girls’ Style# G-0357-00 Pink Genie costume consisting of a blouse, pants and headgear. The blouse and pants are constructed of knit polyester fabric; the long sleeve blouse has nylon net sleeves. The well made blouse reaches to the waist and features faux vest styling, finished neck and edges, sturdy seams and a rear hook and loop closure. The well made pants feature a finished drop waist, sturdy seams and finished ankles. The genie-style headgear is constructed of knit polyester fabric with a knit nylon net veil.
The Style# G-0357-00 Pink Genie costume consists of two or more garments. Note 14 of Section XI, of the HTSUS, requires that textile garments of different headings be separately classified, thus preventing classification of costumes consisting of two or more garments as sets. If a set cannot exist by application of Note 14, the articles that may be packaged with the garments must also be classified separately.
The applicable subheading for the Style# G-0357-00 blouse will be 6106.20.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Women’s or girls’ blouses…knitted or crocheted: Of man-made fibers: Other, Girls’: Other.” The duty rate will be 32.5% ad valorem. The textile category is 639.
The applicable subheading for the Style# G-0357-00 pants will be 6104.63.2028, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Women’s and girls’…dresses, skirts, divided skirts, trousers…knitted or crocheted…Trousers, bib and brace overalls, breeches and shorts: Of synthetic fibers: Other: Other, Trousers and breeches: Girls’: Other: Other.” The duty rate will be 28.2% ad valorem. The textile category designation is 648.
The applicable subheading for the Style# G-0357-00 headgear will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hats or other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric…Other: Other: Of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: Not in part of braid…Other.” The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659.
