RE: The tariff classification of girl’s pants from China.
Dear Mr. Duncan:
In your letter dated December 5, 2007, on behalf of UNIQLO, you requested a classification ruling. As requested, the sample will be returned to you.
The submitted sample, described by you as pants with an attached skirt is constructed of cotton knit fabric. The legging style pants feature an enclosed elasticized waist and peplum and have a hemmed bottom.
The applicable subheading for the pants will be 6104.62.2028, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts, knitted or crocheted: trousers, bib and brace overalls: of cotton: other, trousers and breeches: girls’: other: other. The duty rate will be 14.9 percent ad valorem.

The pants fall within textile category 348. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
