RE: The tariff classification of two travertine tiles from the Philippines

Dear Mr. Landa:

In your letter dated December 12, 2007, on behalf of your client, First Coast Research & Design Corporation, you requested a tariff classification ruling. Representative samples were submitted and were sent to our Customs and Border Protection laboratory for analysis. The laboratory has now completed its analysis.

The submitted sample, designated in your letter as “Olango Ash Tile” - item number 20060, is a beige and brown mottled flat piece of stone with a honed surface. The voids on the top surface have been filled. The stone measures approximately 30.6 cm square x 24.0 mm thick.

The submitted sample, designated in your letter as “Olango Rose Tile” - item number 20010, is a beige and pink mottled flat piece of stone with a honed surface. The voids on the top surface have been filled. The stone measures approximately 30.5 cm square x 20.7 mm thick.

Our Customs laboratory has determined that each tile (Olango Ash and Olango Rose) is composed of non-agglomerated travertine with a honed surface.

The applicable subheading for the two honed travertine tiles will be 6802.91.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for worked monumental or building stone…and articles thereof…other: travertine: other. The rate of duty will be 3.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
