RE: The tariff classification of a man’s pair of ski/snowboard pants from China

Dear Ms. Ruiz:

In your letter dated January 14, 2007, on behalf of Bonfire Snowboarding Co., you requested a classification ruling.

The sample submitted, style number BOF7PM202 “M Path Horizon Pant,” is a man’s pair of ski/snowboard pants with a shell composed of a woven 100% nylon fabric that has a visible polyurethane coating on the inner surface. The garment is lined with a knit mesh fabric and has finely knit brushed tricot fabric inserts in the rear seat and in the lower thigh and knee areas.

The garment is ankle-length and has a fly front zipper opening with an overlapping flap secured by two snaps on the front portion of the waistband, five belt loops and an elasticized belt that is covered in the rear by a self-fabric tunnel and is secured on each side of the waistband by a hook and loop fastener. The garment has two slanted front pockets and two rear pockets with zipper closures, two zipper openings with a mesh fabric insert for ventilation on the thighs and two zippered pockets below the knee area, long hemmed legs with a vent opening at the ankle secured by three snap closures, hidden leg sleeves with elastic tightening at the ankle, a pocket secured by a flap with a snap closure on the right leg sleeve and sealed seams in the front and back rise.

The applicable subheading for the ski/snowboard pants will be 6210.40.5031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Other men’s or boys’ garments: Of man-made fibers: Other: Trousers, breeches and shorts: Ski/snowboard pants. The duty rate will be 7.1 percent ad valorem.

The garment falls within textile category 647. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
