RE: The tariff classification of compact photo printers from Japan and China
Dear Mr. Bonilla:
In your letter dated March 3, 2008, you requested a tariff classification ruling.
The items concerned are three (3) compact photo printers, which you have identified as the Selphy ES1 (Item # 0324B001AA) which is made in Japan, the Selphy CP730 (Item # 1314B005AB) and Selphy CP510 (Item # 0326B001AA) both of which are made in China.
You state in your Ruling Request that all three compact photo printers are capable of connecting to an automatic data processing machine via a Type B USB connection in addition to having additional memory card slots which allow for photos to be printed from SD, CF Card and Memory Sticks. All three compact photo printers can print wirelessly from Bluetooth enabled camera phones using an optional Bluetooth adapter. Both the Selphy ES1 and Selphy CP730 have small LCD screens which allow for the user to preview the photo.
In addition, you state in your Ruling Request that all three compact photo printers use the same type of “paper / ink cartridge…[to]…allow for one-step printing”. All three compact photo printers use a dye-sublimation thermal print method with protective overcoating.
The applicable subheading for the Selphy ES1 (Item # 0324B001AA), Selphy CP730 and Selphy CP510 (Item # 0326B001AA) will be 8443.32.1050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “…other printers…: Other printers…: Other, capable of connecting to an automatic data processing machine…: Printer units: Thermal transfer”. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
