RE: The tariff classification of a girl’s garment from China.
Dear Ms. Stanczak:
In your letter dated March 6, 2008, you requested a tariff classification ruling. The sample will be returned to you.
Your submitted sample, style 4010C, which you call a Hooded Sleeve Jacket
is constructed from 90% nylon, 10% spandex knit fabric. The outer surface of the garment measures over nine stitches per two centimeters in the direction the fabric is formed. The garment features a hood, short sleeves, a full front opening secured with a zipper closure and a hemmed bottom. The article is not a jacket because it does not offer sufficient protection against the elements
The applicable subheading for style 4010C will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other, other: women’s or girls’: other. The rate of duty will be 32 percent ad valorem.
Style 4010C falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
