RE: The tariff classification of two decorative type ribbons, from Taiwan.
Dear Ms. Shanteau:
In your letter dated April 2, 2008, you requested a tariff classification ruling.
The first item, style DG-W801B-1, consists of a ribbon of woven construction that will be imported in 7-inch widths and 12-foot lengths. You state that this ribbon contains a fast edge that has been produced from a hot cutting method. The ribbon is composed of 55% by weight of gimped metallic yarns and 45% other man-made fibers. Please note that a yarn that contains any amount of metal is regarded in its entirety as "metalized yarn" for tariff purposes. Thus, the determination of which textile material predominates by weight is based not on the actual weight of metal, but on the actual weight of all yarns that contain metal.
The second item, style DG-W801B-5, consists of a ribbon of woven construction that will also be imported in 7-inch widths and 12-foot lengths. You write that this ribbon contains a fast edge that has been produced from a hot cutting method. The ribbon is composed of 100% nylon man-made fibers.
The applicable subheading for style DG-W801B-1 will be 5806.39.3020 , Harmonized Tariff Schedule of the United States (HTSUS), which provides for other narrow woven fabrics, other than goods of heading 5807; . . . of metallized yarn. The duty rate is Free.
The applicable subheading for style DG-W801B-5 will be 5806.32.1095 , Harmonized Tariff Schedule of the United States (HTSUS), which provides for … other narrow woven fabrics, of man-made fibers, ribbons, … of a width exceeding 12 cm. The duty rate will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
