RE: The tariff classification of a men’s sweater from China.

Dear Ms. Mendoza:

In your letter dated April 22, 2008, you requested a tariff classification ruling. As requested, your sample will be returned.

Style R308693 is a men’s sweater constructed from 100% wool, knit fabric that measures 9 stitches per 2 centimeters counted in the horizontal direction. The garment features a jersey knit crew neckline, long sleeves with rib knit cuffs, a screen print on the front panel, and a rib knit waistband.

The applicable subheading for Style R308693 will be 6110.11.0015, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of wool or fine animal hair: of wool: sweaters: men's. The rate of duty will be 16% ad valorem.

Style R308693 falls within textile category 445.
