RE: The tariff classification of men’s T-shirts from Bangladesh.
Dear Ms. Zhu:
In your letter dated April 24, 2008, which was received by this office on May 13, 2008, you requested a tariff classification ruling. As requested, your sample will be returned.
Style 671-M “Economy Men’s T-Shirt” is a men’s all-white T-shirt constructed from 100% cotton, finely knit jersey fabric that weighs 115 grams per square meter. The T-shirt has a round neckline finished with self-fabric capping, short hemmed sleeves, and a straight hemmed bottom. Style 671-M will be imported only in all-white. The same garment will be imported in orange as Style 673.
You state that Styles 671-M and 673 will be imported in sizes S - 10XL for use in government detention facilities. The garment measurements are consistent with men’s size specifications. Consequently, the applicable subheading for Style 671-M “Economy Men’s T-Shirt” will be 6109.10.0004, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton: men’s or boys’: T-shirts, all white, short, hemmed sleeves, crew or round neckline, or V-neck, with a mitered seam at the center of the V, without pockets, trim or embroidery. The duty rate is 16.5% ad valorem.
The applicable subheading for Style 673 “Economy Men’s T-Shirt” will be 6109.10.0012, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton: men’s or boys’: other T-shirts: men’s. The rate of duty is 16.5% ad valorem.

Style 671-M falls within textile category designation 352. Style 673 falls within textile category designation 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
