RE: The tariff classification of kitchen cabinets from Canada.
Dear Ms. Van Camp:
In your letter dated June 27, 2008, on behalf of Kitchen Craft of Canada, you requested a tariff classification ruling.
Custom-built kitchen cabinets in various sizes will be imported partially assembled. Toe kicks, mouldings, fillers and columns will be added during installation. All components are made of wood and cut to size to complete the installation of the cabinets. You also request classification of the parts if shipped separately.
The applicable subheading for the kitchen cabinets with toe kicks, mouldings, fillers and columns will be 9403.40.9060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Wooden furniture of a kind used in the kitchen: Other: Cabinets designed for permanent installation”. The rate of duty will be free.
The applicable subheading for the toe kicks, mouldings, fillers and columns if imported separately and cut to size for installation with the kitchen cabinets will be 9403.90.7000, HTSUS, which provides for: “Other furniture and parts thereof: Parts: Other: Of wood”. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
