RE: The tariff classification of pillowcases from China
Dear Ms. McKnight:
In your letter dated August 19, 2008 you requested a classification ruling on behalf of Welspun USA.
The submitted samples, style names Kaden, Darby, Parker, Claire and Tristen, are pillowcases. All of the pillowcases are made from a 100 percent cotton woven fabric. The fabric is not printed or napped. The open end of pillowcases features a 4-inch wide self hem. Style Kaden features a ? inch wide embroidered hem treatment with a leaf and vine design. Style Claire contains a ½ inch wide embroidered hem treatment depicting the outlines of a 3 strand braid. The hem on style Darby is finished with a ¼ inch wide embroidered linked loop design. The hem on style Tristen is finished with a ? inch wide embroidered leaf and vine design. Although highly decorative these embroidered stitches are the only stitches holding the hem. Following Headquarters Ruling Letter (HQ) 955576, dated June 1, 1994, noted that if the decorative stitching was required to complete the hem, it was functional and therefore did not constitute embroidery. In this case the decorative stitching used on style names Kaden, Claire, Darby and Tristen is not considered embroidery.
Style Parker has a ? inch wide hem treatment that contains three separate rows of embroidered stitching in a Greek key design. One row holds the hem while the other two are considered embroidery.
The applicable subheading for style names Kaden, Claire, Darby and Tristen will be 6302.31.9010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other bed linen: of cotton: other: not napped… pillowcases, other than bolster cases. The duty rate will be 6.7 percent ad valorem.
The applicable subheading for style name Parker will be 6302.31.5010, HTSUS which provides bed linen, table linen, toilet linen and kitchen linen: other bed linen: of cotton: containing any embroidery, lace, braid, edging, trimming, piping or applique work: not napped… pillowcases, other than bolster cases. The duty rate will be 20.9 percent ad valorem.

The pillowcases fall within textile category 360. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
