RE: The tariff classification of on-off valves, pilot valves, and solenoids from Germany
Dear Mr. Connors:
In your letter dated September 3, 2008 you requested a tariff classification ruling on behalf of your client, Thomas Magnete Canada Inc. Drawings, descriptive literature, and samples were submitted.
The products your client plans to import are on-off valves, pilot valves, and solenoids. Based on our examination of the submitted samples, the on-off and pilot valves are actually valve mechanisms assembled together with a solenoid actuator. The valve mechanisms, when assembled into a valve manifold within a double-clutch transmission, are used to control the flow of hydraulic fluid within the transmission. The separately presented solenoid is the actuator for the valve mechanisms.
We find that the on-off and pilot “valves” are not complete valves, but rather parts of valves for the transmission of hydraulic fluid. Valves for the transmission of hydraulic fluid are provided for in subheading 8481.20.0000, Harmonized Tariff Schedule of the United States (HTSUS).
The applicable subheading for the on-off valves and pilot “valves” will be 8481.90.9040, HTSUS, which provides for other parts of the valves of subheading 8421.20. The rate of duty is free.
The applicable subheading for the solenoids will be 8505.90.8000, HTSUS, which provides for electromagnetic lifting heads: other, including parts: other. The rate of duty will be 1.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
