RE: The tariff classification of a jacket from China.
Dear Mr. Krueger:
In your letter dated September 8, 2008 on behalf of Orvis Company, you requested a classification ruling. The sample which you submitted is being returned as requested.
The submitted sample Style 9H06 is a “Men’s Ultrasuede Jacket”. The jacket is made of non-woven fabric coated on the inner surface with a polyurethane membrane. The garment is lined with polyester fleece and the sleeves are lined with nylon fabric. The jacket has rib knit cuffs and waist, a full front zipper closure, and a stand-up collar.
The applicable subheading for the Style 9H06 will be 6210.10.9040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Of fabrics of heading 5602 or 5603: Other: Other: Other, Other.” The duty rate will be 16 percent ad valorem. The textile category designation is 659.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
