RE: The tariff classification of a rug from India
Dear Ms. Chapa:
In your letter dated September 16, 2008 you requested a classification ruling.
The submitted sample, SKU 2345169, is a section of a flat woven rug. The sample also represents SKU 2345171 which differs in color and size from the submitted sample. The rug is made from 100 percent cotton yarns. It is hemmed at the ends with selvage along the sides. Multiple weft yarns are woven as one creating a ribbed surface. You state that the rug is hand loomed. It will measure either 32 x 56 inches or 20 x 34 inches.
The applicable subheading for the rug will be 5702.99.0500., Harmonized Tariff Schedule of the United States (HTSUS), which provides for carpets and other textile floor coverings, woven, not tufted or flocked, whether or not made up, including "Kelem", "Schumacks", "Karamanie" and similar hand-woven rugs: other, not of pile construction, made up: of other textile materials: of cotton: woven, but not made on a power-driven loom. The duty rate will be 6.8 percent ad valorem.

The rug falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
