RE: The tariff classification of polyethylene terephthalate strapping from China

Dear Mr. Vroman:

In your letter dated December 29, 2008, on behalf of La Suprema Enterprise Inc., you requested a tariff classification ruling.

The product is strapping material made from polyethylene terephthalate (PET). Photographs were included with your request. The strapping is imported on rolls and is used for packaging. You state that the PET is noncellular and is not laminated, reinforced or otherwise supported with any other materials. The strapping is imported in widths of 1/2 inch and 5/8 inch.

The applicable subheading for the PET strapping will be 3920.62.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other plates, sheets, film, foil and strip, of plastics, noncellular and not reinforced, laminated, supported or similarly combined with other materials: of polycarbonates, alkyd resins, polyallyl esters or other polyesters: of poly(ethylene terephthalate)…other. The rate of duty will be 4.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
