RE: The tariff classification of disposable lab coats from China.
Dear Mr. Kirk:
In your letter dated February 16, 2009, on behalf of Life Science Products Inc., you requested a tariff classification ruling. The samples which you submitted are being returned as requested.
Four samples of disposable lab coats were submitted with your request. The lab coats are made of non-woven spun bonded polypropylene textile fabric. You state that garments are used in contaminated areas as protection against various contaminates.
Style LC-1102PK is a blue full length lab coat with a full front opening and a five snap closure. The lab coat has knit textile fabric collar and cuffs. The garment also has two patch pockets and a left breast pocket.
Style LC-1102P is a full length lab coat with a full front opening and a five snap closure. The lab coat has a pointed collar and an open cuff.
Style LC-1103PE is a full length lab coat with a full front opening and a five snap closure. The lab coat has a pointed collar and elastic at the wrists.
Style LC-1103PK is a full length lab coat with a full front opening and a five snap closure. The lab coat has knit textile fabric collar and cuffs. The garment also has two patch pockets and a left breast pocket.
The applicable subheading for the Styles LC-1102PK, LC-1102P, LC-1103PE and LC-1103PK will be 6210.10.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Garments, made up of fabrics of heading 5602, 5603, 6903, 5906 or 5907: Of fabrics of heading 5602 or 5603: Other: Non-woven disposable apparel designed for use in hospitals, clinics, laboratories or contaminated areas." The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
