RE: The tariff classification of polypropylene twine from various countries

Dear Mr. Coath:

In your letter dated May 8, 2009, you requested a tariff classification ruling.

The submitted sample is a split film polypropylene twisted twine constructed of fibrillated strip that has been more or less completely split by twisting. The diameter is less than 4.8 mm.

You state that it is used to bale hay, specifically round bales of hay. However, we note from our examination that it has an ā€œSā€ twist. The Explanatory Note to subheading 5607.41, in which baler twine is defined for tariff purposes, requires a ā€œZā€ twist.

The applicable subheading for the split film polypropylene twine will be 5607.49.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for twine, cordage, ropes and cables, of polypropylene, other, other, not braided or plaited, measuring less than 4.8mm in diameter. The rate of duty will be 7% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
