RE: The tariff classification of a triplex wall jack adapter and a cable with a 5-jack adapter from China.
Dear Ms. Smith:
In your letter dated July 30, 2009 you requested a tariff classification ruling.
The items under consideration are identified as item number 76160, the Triplex Adapter, and item number 26131, the 5-Jack Adapter.
From the information you provided, the Triplex Adapter is a simple triplex adapter assembly within a plastic housing, comprised of three RJ-series sockets with an RJ-series plug protruding out the back. It is inserted into a standard telephone jack to allow for the connection of up to three telecommunications devices, such as telephones, answering machines, fax machines, modems, etc., through one single line modular socket.
The 5-Jack Adapter features a 5 foot long cable with an RJ-series connector at one end and 5 RJ-series sockets within a plastic housing on the other. The RJ connector is inserted into a standard telephone jack, while the 5-socket housing may be mounted on a wall or baseboard. Up to five telecommunications devices may be connected through the 5-Jack Adapter.
The applicable subheading for item number 76160, the Triplex Adapter, will be 8536.69.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical apparatus for switching or protecting electrical circuits, or for making connections to or in electrical circuits (for example, switches, relays, fuses, surge suppressors, plugs, sockets, lamp-holders, junction boxes), for a voltage not exceeding 1,000 V: Lamp-holders, plugs and sockets: Other: Other.”. The general rate of duty will be 2.7 percent ad valorem.
The applicable subheading for item number 26131, the 5-Jack Adapter, will be 8544.42.1000, HTSUS, which provides for “Insulated (including enameled or anodized) wire, cable (including coaxial cable) and other insulated electric conductors, whether or not fitted with connectors…: Other electric conductors, for a voltage not exceeding 1,000 V: Fitted with connectors: Fitted with modular telephone connectors.”. The general rate of duty will be Free.
