RE: The tariff classification of a receptacle assembly from Taiwan.
Dear Ms. Corby:
In your letter dated January 7, 2010, you requested a tariff classification ruling.
The merchandise under consideration is an electrical receptacle assembly, part number 06702021. It consists of a housing containing a two-prong electrical receptacle, with three 6-inch wire leads attached to the receptacle by poke-in or ring terminal. This receptacle assembly is rated for 125 volts (V) and 5 amps (A), and is designed for hardwire installation into a household bathfan housing so that the motor, lighting or heat fixture may be plugged into the receptacle. The assembly is designed to fit directly into a precut opening of the bathfan housing measuring approximately ½-inch by 1-inch, and is held in place by means of two spring-type metal clips attached to the receptacle.
In your ruling request you suggest classification of the receptacle assembly in 8536.90.8085 Harmonized Tariff Schedule of the United States (HTSUS), as other electrical apparatus. However, this receptacle assembly is a rack and panel connector more specifically provided for in 8536.69.4030, HTSUS.
The applicable subheading for the receptacle assembly, part number 06702021 will be 8536.69.4030, HTSUS, which provides for “Electrical apparatus for switching or protecting electrical circuits, or for making connections to or in electrical circuits (for example, switches, relays, fuses, surge suppressors, plugs, sockets, lamp-holders or other connectors, junction boxes) for a voltage not exceeding 1,000 V…: Lamp-holders, plugs, and sockets: Other: Coaxial connectors; cylindrical multicontact connectors; rack and panel connectors…: Rack and panel connectors.” The general rate of duty will be Free.
