RE: The tariff classification of Cool Wave Splash™ After-Shave Lotion from France

In your letter dated January 14, 2010, you requested a tariff classification ruling on behalf of your client The Gillette Company.
Cool Wave Splash™ After-Shave Lotion contains denatured alcohol, water, fragrance, PEG-40, and hydrogenated castor oil. Cool Wave Splash™ After-Shave Lotion, sold in retail bottles, is an antiseptic and soothing lotion for shaved skin.
The applicable subheading for the Cool Wave Splash™ After-Shave Lotion will be 3307.10.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Pre-shave, shaving or after-shave preparations, personal deodorants, bath preparations, depilatories and other perfumery, cosmetic or toilet preparations, not elsewhere specified or included; prepared room deodorizers, whether or not perfumed or having disinfectant properties: Pre-shave, shaving or after-shave preparations: Containing alcohol. The rate of duty will be 4.9 percent ad valorem.
