RE: The tariff classification of various airgun ammunition from China.

Dear Ms. Jordan:

In your letter dated February 07, 2011, you requested a tariff classification ruling.

The ammunition under consideration is as follows:

Paintball pellets for paintguns. Airsoft BB’s of plastic for airsoft guns. Copperhead BB’s for airguns. Pointed lead pellets for long range for use with airguns. Hard tipped pellet for airguns.

The applicable subheading for the Pointed lead pellets, and the hard tipped pellets for airguns , will be 9306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Bombs, grenades, torpedoes, mines, missiles and similar munitions of war and parts thereof; cartridges and other ammunition and projectiles and parts thereof, including shot and cartridge wads: Shotgun cartridges and parts thereof; air gun pellets: Other”. The general rate of duty will be Free.

The applicable subheading for the Airsoft BBs made of plastic, and the Copperhead BB’s for airguns , will be 9306.90.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Bombs, grenades, torpedoes…and similar munitions of war and parts thereof; cartridges and other ammunition and projectiles and parts thereof, including shot and cartridge wads: Other: Bombs, grenades, torpedoes, mines and similar munitions of war; other ammunition and projectiles." The general rate of duty will be Free.

Your inquiry does not provide enough information for us to give a classification ruling on the “paintball pellets for paintguns” (Item Number 1 from the list above). A sample of the product in condition as imported is needed. Please also include any marketing or instructional literature that may be present. When this information is available, you may wish to consider resubmission of your request.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
