RE: The tariff classification of Techkleen BO from China
Dear Ms. Sciarra:
In your letter dated October 21, 2011 you requested a tariff classification ruling on behalf of your client Tech Chem Limited (Tech Chem). In the letter you also requested confidential treatment with regard to the material specification information for the product. The request was reviewed, and a confidentially denial letter was issued on October 31, 2011.
Techkleen BO is an organic solvent composed of more than 98% N-Propyl bromide, CAS No. 106-94-5, and less than 2% 1,2-Epoxybutane. As stated in your letter, 1,2-Epoxybutane is specifically added as a stabilizer during transport for the preservation of the product. Based on Chapter Note 1(f) to Chapter 29, separate chemically defined organic compounds with an added stabilizer necessary for their preservation or transport remain classified in Chapter 29. Accordingly, Techkleen BO is a separate chemically defined organic compound. The product, chemically known as N-Propyl bromide, is a brominated derivative of an acyclic hydrocarbon (alkyl bromide.) The product is a chemical intermediate indicated for use in the manufacture of adhesive, aerosol, and metal cleaning products.
The applicable subheading for Techkleen BO will be 2903.39.1550, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Halogenated derivatives of hydrocarbons: Fluorinated, brominated or iodinated derivatives of acyclic hydrocarbons: Other: Alkyl bromides: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
