RE: The tariff classification of a low voltage timer

Dear Mr. Des Champs:

In your letter dated September 25, 2012 you requested a tariff classification ruling.

The timer is described as a low voltage timer, which is used with a motor on a stackable paint mixing machine. The timer connects directly to the motor and determines the motor run time of either 15 minutes or 30 minutes. The power supply is located in the motor and supplies low voltage to the timer. The elapsed time is determined through a programmable microchip and microprocessor located on the timer circuit board. According to information that you supplied in a telephone conversation, the timer turns the motor on and off at 15 minute or 30 minute intervals. The timer circuit board is considered to be a clock or watch movement in that the timer circuit board determines intervals of time. The timer will be imported separately from the motor. The applicable subheading for the low voltage timer, if valued not over $5 each, will be 9107.00.4080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for time switches with clock or watch movement or with synchronous motor: valued not over $5 each: other. The rate of duty will be 15 cents each plus 4 percent ad valorem plus 2.5 cents per jewel.

The applicable subheading for the low voltage timer, if valued over $5 each, will be 9107.00.8000, HTSUS, which provides for time switches with clock or watch movement or with synchronous motor: valued over $5 each. The rate of duty will be 45 cents each plus 6.4 percent ad valorem plus 2.5 cents per jewel.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
