RE: The tariff classification of Maca Extract Powder and Ungurahui Oil
Dear Ms. Duran:
In your letter dated December 4, 2012, on behalf of your client, Freedom Actives, you requested a tariff classification ruling.
The subject merchandise Ungurahui Oil is obtained from the fruit of the Oenocarpus Bataua tree. The oil is cold pressed and imported in bulk. It will be used for manufacturing cosmetic products.
The applicable subheading for the Ungurahui Oil will be 1515.90.8090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: “Other fixed vegetable fats and oils (including jojoba oil) and their fractions, whether or not refined, but not chemically modified: Other: Other: Other.” The rate of duty will be 3.2 percent ad valorem.

In your letter, you made a request for classification for the product Maca Extract Powder. We need additional information in order to issue a ruling. Please submit the following information so we may assist you with your request:
A sample of the product in its condition as imported.
A breakdown of component materials and ingredients by weight.
A detailed manufacturing flow chart showing each step in the extraction process.
