RE: The tariff classification of an article of insulating mineral material from Spain

Dear Mr. Yan:

In your letter received February 4, 2013, on behalf of Zen Continental, you requested a tariff classification ruling regarding an unassembled article (Suaval Kit 111) consisting of insulating mineral material (Microtherm Super G) within metal piping.

The kit includes the insulating mineral material itself, metal piping, metal sheets, rivets, clamps and other components. These components are intended to be put together to form an article of insulating mineral material.

A sample of the Microtherm Super G material was submitted with your ruling request. The sample was sent to our U.S. Customs and Border Protection (CBP) laboratory. Our laboratory has now completed its analysis of this material.

Our CBP laboratory has determined that the Microtherm Super G material consists of insulating mineral material.

The applicable subheading for the unassembled article of insulating mineral material will be 6806.90.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for slag wool, rock wool and similar mineral wools; exfoliated vermiculite, expanded clays, foamed slag and similar expanded mineral materials; mixtures and articles of heat-insulating, sound-insulating or sound-absorbing mineral materials, other than those of heading 6811 or 6812, or of chapter 69: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
