RE: The tariff classification of a rubber ring from Italy

Dear Mr. Vozzolo:

In your undated letter, which was received in this office on March 11, 2013, you requested a tariff classification ruling on behalf of your client AZG, LLC, Georgia.

The sample submitted with your request is identified as a ring used in the sorting line of a ceramics factory for rotating and depositing tiles on a forming stack. The ring measures approximately 2 ½ inches in diameter and 1 ¼ inches in depth. You state that it is made from a blend of natural rubber and styrene butadiene synthetic rubber.

You suggest classification in subheading 4006.90 of the Harmonized Tariff Schedule of the United States (HTSUS), which provides for other forms (for example, rods, tubes and profile shapes) and articles (for example, discs and rings), of unvulcanized rubber. However, the ring that is the subject of this request is made of vulcanized rubber.

The applicable subheading for the rubber ring will be 4016.99.6050, HTSUS, which provides for other articles of vulcanized rubber other than hard rubber: other…other. The rate of duty will be 2.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
