RE: The tariff classification of Netherwine from Netherlands
Dear Mr. Back:
In your letter dated November 07, 2013 you requested a tariff classification ruling.
The two instant beverages are known as Netherwine (other than standard) with an alcohol content of 20.75 and 23.75 percent alcohol by volume respectively. You provided an ingredients list and processing information, in addition to data on the source of the alcohol in the products. An unlabeled sample was received by our office. The product appeared visually clear/colorless similar to a water or a grain alcohol.
The applicable subheading for the Netherwine (other than standard) with an alcohol content of 20.75 or 23.75 percent alcohol by volume will be, 2208.90.7100 Harmonized Tariff Schedule of the United States (HTSUS), which provides for: “Undenatured ethyl alcohol of an alcoholic strength by volume of less than 80 percent vol.; spirits, liqueurs and other spirituous beverages (con.): Other: Other: Imitations of brandy and other spirituous beverages. The rate of duty will be Free.
