RE: The tariff classification of a snow blanket, a snow drape, a snow skirt, and plastic artificial snowflakes from China
Dear Mr. Pearce:
In your letter dated June 12, 2014, you requested a tariff classification ruling.
You have requested a classification ruling on four different items of artificial snow for decorating. Items 972768, 973758, and 973759 are a polyester Snow Blanket, Polyester Snow Drape, and Polyester Snow Skirt, respectively. All three are stated to be manufactured the same way but packaged into different sizes and shapes. The Snow Blanket and the Snow Drape are rectangular in shape while the Snow skirt is round. Based on the manufacturing process you describe in your request letter, all three items are constructed of nonwoven textile fabric.
The applicable subheading for the Snow Blanket and the Snow Drape will be 5603.91.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Nonwovens, whether or not impregnated, coated, covered or laminated: Other: Weighing not more than 25 g/m² Other. The duty rate will be Free.
The applicable subheading for the Snow Skirt will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other made up articles, including dress patterns: Other: Other: Other: Other. The duty rate will be 7 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the 3.5 quart bag of artificial snowflakes. Your request for a classification ruling should identify the polymer comprising the flakes (e.g., polyethylene, polyester). If the material is a copolymer, you must provide a breakdown of each monomer by weight. If a polyester, you must provide complete details regarding the exact type (e.g., polyethylene terephthalate,) and you must indicate whether the polyester is saturated or unsaturated. When this information is available, you may wish to consider resubmission of your request. The sample of the artificial snowflakes will be held in this office for 60 days pending receipt of your follow-up request.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
