RE: The tariff classification of Enclomiphene (CAS 15690-57-0), imported in bulk form, from France
Dear Ms. Brunciak:
In your letter dated June 4, 2014, you requested a tariff classification ruling.
The subject product, Enclomiphene, is a non-steroidal estrogen receptor antagonist that promotes
Gonadotropin-dependent testosterone secretion by the testes. Enclomiphene constitutes the trans-stereoisomer of clomiphene citrate. It is currently undergoing phase III clinical studies for the treatment of men with secondary hypogonadism.
The applicable subheading for the Enclomiphene, imported in bulk form, will be 2922.19.0900, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Oxygen-function amino-compounds: Amino-alcohols, other than those containing more than one kind of oxygen function, their ethers and esters; salts thereof: Other: Aromatic: Drugs.” Pursuant to General Note 13, HTSUS, the rate of duty will be free.
