RE: The tariff classification of Treprostinil Sodium (CAS 289480-64-4) and Brinzolamide USP (CAS 138890-62-7) both imported in bulk form, from Korea and Italy, respectively
Dear Ms. Brunciak:
In your letter dated March 10, 2015 you requested a tariff classification ruling.
The first product, Treprostinil Sodium, is a synthetic analog of prostacyclin (PGI 2). This vasodilator is indicated for the treatment of pulmonary hypertension to diminish symptoms associated with exercise.
The second product, Brinzolamide USP, is in a class of drugs called carbonic anhydrase inhibitors. It decreases the pressure in the eye and is indicated for the treatment of elevated intraocular pressure in patients with ocular hypertension or open-angle glaucoma.
The applicable subheading for the Treprostinil Sodium in bulk form will be 2937.50.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hormones, prostaglandins, thromboxanes and leukotrienes, natural or reproduced by synthesis; derivatives and structural analogues thereof, including chain modified polypeptides, used primarily as hormones: Prostaglandins, thromboxanes and leukotrienes, their derivatives and structural analogues.” The rate of duty will be free.
The applicable subheading for the Brinzolamide USP in bulk form will be 2935.00.6000, HTSUS, which provides for “Sulfonamides: Other: Drugs: Other.” Pursuant to General Note 13, HTSUS, the rate of duty will be free.
