RE: The tariff classification of Anti-Actin antibody [EPR16769] ab179467, from China

Dear Ms. Tuccillo:

In your letter dated June 2, 2015, you requested a tariff classification ruling. Technical information including a data sheet was included with your request.

The subject product, Anti-Actin antibody [EPR16769] ab179467, is a purified rabbit monoclonal antibody. According to the data sheet, the monoclonal antibody is put up in in a storage buffer solution containing 0.01% sodium azide, as a preservative, phosphate buffer saline (PBS), glycerol and bovine serum albumin (BSA). The monoclonal antibody will be imported in 40 or 100 microlitres units at a concentration of 0.698 mg/mL. You indicated that this product will be used for in-vitro life science research purposes only and that it will be imported directly for retail sale to your customers.

The applicable subheading for the Anti-Actin antibody [EPR16769] ab179467 will be 3002.10.0290, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Human blood; animal blood prepared for therapeutic, prophylactic or diagnostic uses; antisera, other blood fractions and immunological products, whether or not modified or obtained by means of biotechnological processes; vaccines, toxins, cultures of micro-organisms (excluding yeasts) and similar products: Antisera, other blood fractions and immunological products, whether or not obtained by means of biotechnological processes: Other.” The rate of duty will be free.
