RE: The tariff classification of Kava powder from Samoa
Dear Mr. Lafaialii:
In your letter dated August 20, 2015, you requested a tariff classification.
Merchandise is kava powder made from the roots of kava (Piper methysticum), and imported for use in supplements and beverages.
The applicable subheading for the kava powder will be 1211.90.9190, Harmonized Tariff Schedule of the United States (HTSUS), which provides for plants and parts of plants (including seeds and fruits), of a kind used primarily in perfumery, in pharmacy or for insecticidal, fungicidal or similar purposes, fresh or dried, whether or not cut, crushed or powdered ... other ... other ... other ... other. The rate of duty will be free.

The importation of this merchandise may be subject to regulations or restrictions administered by the U.S. Department of Agriculture, Animal and Plant Health Division (APHIS) and/or the U.S. Food and Drug Administration. It is suggested you contact these agencies directly for further information.
