RE: The tariff classification of “Kinetic Foam” from China
Dear Ms. Rule:
In your ruling request received December 1, 2015, on behalf of your client, Spin Master Inc., you requested a tariff classification ruling on “Kinetic Foam.” The provided sample has been reviewed and will be returned.
Your provided sample is packaged in a clear blister pack and suitable for retail sale in its imported condition. Each package includes a total of thirty-nine cubic inches of red, blue, and green “Kinetic Foam.” You state that “Kinetic Foam” is a soft, moldable compound composed predominantly of glycerol, polyvinyl alcohol, and polystyrene beads.
The applicable subheading for “Kinetic Foam” will be 3407.00.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Modeling pastes, including those put up for children’s amusement. The general rate of duty will be free.
This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
