RE: The tariff classification of a pressure infusion bag and a CT transfer set from Mexico.
Dear Ms. Herrera:
In your letter dated November 23, 2015, on behalf of Merit Medical Systems, Inc., you requested a tariff classification ruling on two items.
The first item, which is identified as a Pressure Infusion Bag, is a specially designed cuff and bladder device used to pressurize sterile fluids, such as blood or IV solutions into a patient. The device consists of a bag with a bladder, an envelope for holding the fluid bag, a pressure gauge and tubing with an inflation bulb and a stopcock. Once the fluid bag is inserted into the envelope, the bag will then be inflated to the desired pressure to assist in the infusion of the fluid.
The second item, which is identified as a CT transfer family, consists of the following components: clear PVC tubing, a plastic spike and cap, and luer-activated valves. The CT transfer family is used to transfer contrast media or saline into a sterile injector syringe. The spike is used to pierce, either the contrast bottle or the saline, which flows through the tubing. The luer-activated valve will be in a closed position until a syringe is attached to the end of the valve, allowing the valve to move to an open position. The CT transfer family does not include a syringe.
The applicable subheading for the Pressure Infusion Bag and the CT transfer family will be 9018.90.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Instruments and appliances used in medical, surgical, dental or veterinary sciences, including scintigraphic apparatus, other electro-medical apparatus and sight-testing instruments; Parts and accessories thereof: Other: Other.” The general rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
