RE: The tariff classification of four polyester narrow warp knit fabrics from China

Dear Ms. Rivera:

In your letter dated April 3, 2016, you requested a tariff classification ruling on behalf of your client, Reliant Ribbon Corp, Inc. The four samples are being returned at your request, less those portions destroyed in testing or retained for file purposes. The samples, identified as Items SI60226-A, SI60226-B, SI60226-D and SI60226-G, are narrow knit fabrics of various designs. According to the information provided and subsequent contact, the four narrow fabrics are composed wholly of polyester, and measure approximately 3.65 centimeters to 5 centimeters in width. Based on visual examination, the four narrow fabrics submitted to this office are of warp knit construction, containing selvages. They are constructed of multiple rows of chain stitches which are separate from the multifilament weft inlay yarns which hold the chaining wales to each other. However, these fabrics are not of open-work construction. You state that the fabrics will be imported in rolls, 100 to 500 yards in length, and will be used primarily to be sewn around mattresses and other related items.

The applicable subheading for Items SI60226-A, SI60226-B, SI60226-D and SI60226-G will be 6003.30.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for knitted or crocheted fabrics of a width not exceeding 30 cm, other than those of heading 6001 or 6002: of synthetic fibers: other. The rate of duty will be 7.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the assumption that the subject goods, in their condition as imported into the United States, conform to the facts and the description as set forth both in the ruling request and in this ruling.  In the event that the facts or merchandise are modified in any way, you should bring this to the attention of Customs and you should resubmit for a new ruling in accordance with 19 CFR 177.2.  You should also be aware that the material facts described in the foregoing ruling may be subject to periodic verification by Customs. 

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
