RE: The tariff classification of glass bottles from China.
Dear Ms. Chin:
In your letter dated August 29, 2016, you requested a tariff classification ruling.
The merchandise under consideration are glass bottles, item numbers PTS27752 and PTS26981. Samples were submitted with your ruling request and will be returned to you.
Item number PTS27752 is made of amber-colored soda-lime glass, has a .01 liter capacity, features a threaded neck, and measures approximately 2.5 inches high by 1 inch in diameter at its widest points. Item number PTS26981 is made of amber-colored soda-lime glass, has a .015 liter capacity, features a threaded neck, and measures approximately 3 inches high by 1 inch in diameter at its widest points.
From the information you provided, after importation, item number PTS27752 will be filled with therapeutic essential oils and fitted with a steel roller ball insert and cap, while item number PTS26981 will be filled with neutraceutical essential oil and fitted with a plastic roller ball insert and cap. The bottles are used to dispense the oil contained within directly on the skin. You state that the bottles are produced by an automatic molding machine, and that once the roller ball inserts are affixed to the bottles, they cannot be removed; the bottles must be discarded when empty.
The applicable subheading for the glass bottles, item numbers PTS27752 and PTS26981, will be 7010.90.2040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Carboys, bottles, flasks, jars, pots, vials, ampoules and other containers, of glass, of a kind used for the conveyance or packing of goods…: Other: Containers (with or without their closures) of a kind used for the conveyance or packing of perfume or other toilet preparations…: Produced by automatic machine: Of a capacity not exceeding 0.15 liter.” The general rate of duty will be 2.5 percent ad valorem.
