RE: The tariff classification of dietary supplements from Taiwan

Dear Ms. Awana:

In your letter, dated September 6, 2016, you requested a tariff classification ruling on behalf of KC Biotech Inc., CA.

Ingredients breakdowns, a production process chart, descriptive literature, and samples accompanied your inquiry. The samples were examined and discarded.

Fruiting bodies of antrodia cinnamonea dropping pills is said to be composed of 30 percent extract of antrodia cinnamonea, and 70 percent polymer composites of polyethylene glycol. Fruiting bodies of phellinus linteuss is said to be composed of 30 percent extract of phellinus linteuss and 70 percent polymer composites of polyethylene glycol. The products are imported in lined decorative satin covered 5½ inch x 4 inch x 2 inch red boxes containing three glass vials of the same product that weigh 24 grams, net weight.

The applicable subheading for the two dietary supplements will be 2106.90.9998, Harmonized Tariff Schedule of the United States (HTSUS), which provides for food preparations not elsewhere specified or included . . . other . . . other . . . other . . . other . . . other . . . other. The general rate of duty will be 6.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA). This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
