RE: The tariff classification of Decitabine Injection in dosage form, from India
Dear Ms. Keeler:
In your letter dated November 10, 2017, you requested a tariff classification ruling.
The subject product, Decitabine Injection in 50 mg vials, is a medicinal preparation containing Decitabine, an antineoplastic drug, as the active ingredient. It is indicated for the treatment of myelodysplastic syndromes (MDS).
The applicable subheading for the Decitabine Injection in dosage form will be 3904.90.9215, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Antineoplastic and immunosuppressive medicaments.” The rate of duty will be free.
