RE: The tariff classification of Cisatracurium Besylate Injection in dosage form, from India
Dear Mr. Shah:
In your letter dated May 1, 2019, you requested a tariff classification ruling.
Cisatracurium Besylate Injection, imported in 2 mg and 10 mg, is an intermediate-onset/intermediate-duration neuromuscular relaxant for intravenous administration. It is indicated for inpatients and outpatients as an adjunct to general anesthesia, to facilitate intubation, and to provide skeletal muscle relaxation during surgery or mechanical ventilation in the ICU.
The applicable subheading for the Cisatracurium Besylate Injection in dosage form will be 3004.90.9240, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the central nervous system: Other.” The rate of duty will be free.
