RE: The tariff classification of polyvinyl chloride (PVC) flooring planks from China
Dear Mr. Edwards:
In your letter dated February 11, 2020 you requested a tariff classification ruling.
The product in question is described as Engineered MgO vinyl plank. A representative sample was provided with the request and will be retained by this office. The plank consists of the following layers: a clear wear layer, a melamine paper printed layer, a layer of polyvinyl chloride, a core of magnesium oxide (MgO) another layer of polyvinyl chloride and an acoustic pad layer. The layers are laminated together under heat and pressure. The plank has profiled edges to create an interlocking (click-lock) mechanism. These planks are imported in various dimensions.
The applicable subheading for the vinyl flooring planks will be 3918.10.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Floor coverings of plastics, whether or not self-adhesive, in rolls or in the form of tiles: Of polymers of vinyl chloride: Floor coverings: Vinyl tile. The rate of duty will be 5.3 percent ad valorem.
Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 3918.10.0000, HTSUS, unless specifically excluded, are subject to an additional 25 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.03, in addition to subheading 3918.10.0000, HTSUS, listed above.
The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
